1. GENERAL

  • 1.1 The purpose of these General Conditions is to define the relations between Laurent Sevestre, editor of the MaximalSound.com site and the users of the services presented on:

    • - "MaximalSound.com" means the MAXIMALSOUND site and services,
    • - "User" means the simple visitor or VIP subscriber using MaximalSound.com.

  • 1.2 By transmitting a file, the User declares that he has read, understood and accepted these General Conditions. 2. LIABILITY

    • - any damage due to force majeure, a fortuitous event or due to a third party.
    • - in the event of a breakdown, a technical problem, particularly related to computer programs, hardware or software or to the Internet. This absence of responsibility is not limited to interruptions, suspensions or closings of the service.

  • 2.2 MaximalSound.com can not be held responsible for direct or indirect damage caused by the loss of data, by fraudulent behavior, by computer hacking, by the accidental transmission or dissemination of viruses or other harmful elements, by the attitude or the behavior of third parties or users.

  • 2.3 The User releases MaximalSound.com, Laurent Sevestre, their employees and their directors from any responsibility for any damage resulting from the use of the site or associated services, regardless of the reason invoked or actual cause of the damage

  • 2.4 Without limiting the scope of the other provisions of these General Conditions, the responsibility of MaximalSound.com, if it were to be engaged, whatever the form of the action or the cause, could not exceed all the combined damages. by the user at MaximalSound.com.

3. CONDITIONS OF ACCESS TO SERVICES

  • 3.3 The User expressly accepts that the services are used at their own risk. MaximalSound.com does not guarantee that:

    • - the services will perfectly meet your expectations,
    • - the services will be uninterrupted, secure, or free from errors,
    • - the results obtained by the services will be exact or reliable.

4. PERSONAL DATA

5. PRICE, ACCOUNT OPERATION AND PAYMENT

  • 5.1 The current prices and conditions of sale are an integral part of these conditions. MaximalSound.com undertakes to highlight and remind them before each purchase of a service offered by MaximalSound.com.

  • 5.2 Payment by credit card is made by secure link and directly on the website of the company "PayPal". Payment security is based on User authentication, confidentiality and data integrity. To ensure this security, proven cryptographic techniques are used. Your card will be debited as soon as the order is placed.

  • 5.3 Any amount paid is final and cannot be reimbursed.

6. MISCELLANEOUS

7. APPLICABLE TEXTS AND COMPETENT JURIDICTION

  • 7.1 These General Conditions and more generally all relations between MaximalSound.com and Users are governed exclusively by French law regardless of the usual place of residence of the User and even in the event of a conflict of laws.
  • 7.2 In the event that one of the provisions is considered illegal by a competent authority, this provision would simply be deemed unwritten, all other provisions remaining binding between the parties.
  • 7.3 Any dispute will be the exclusive jurisdiction of the competent courts. The simple use of the site is worth the User's agreement for all the clauses of these General Conditions.
